These Terms & Conditions (“Terms”) govern your access to and use of afscorporate.com.my and its company pages (the “Website”), operated by AFS Corporate Sdn. Bhd. (Registration No. 202601039081 (1701176-P)) on behalf of itself and its subsidiaries, together known as AFS Group of Companies (“AFS Group”, “we”, “us” or “our”). By accessing or using the Website you agree to be bound by these Terms. If you do not agree, you must not use the Website.

1. Eligibility

You must be at least 18 years old, or have the consent of a parent or guardian, to use the Website. If you use the Website on behalf of an organisation, you confirm that you are authorised to accept these Terms on its behalf.

2. Information only — no offer or advice

The Website provides general corporate information about AFS Group and its companies. Nothing on it is an offer, invitation or solicitation to buy or sell securities, to enter into a contract or to invest, and nothing on it is professional, financial, investment, tax, legal or technical advice. Descriptions of businesses, projects, capabilities and plans are indicative, may include forward-looking statements that involve risks and uncertainties, and do not form part of any contract. Any engagement with a group company is governed solely by the written agreement signed with that company.

3. Group companies

Each company within AFS Group is a separate legal entity responsible for its own business, obligations and commitments. A reference to “AFS Group” or “the group” is for convenience only and does not mean that one company is liable for another.

4. Accuracy and availability

We take reasonable care to keep the Website accurate and up to date, but we give no warranty, express or implied, that its content is complete, accurate, current or fit for any purpose. Content may be changed, suspended or withdrawn at any time without notice. We do not guarantee that the Website will be uninterrupted, secure, or free from errors, viruses or other harmful components, and you are responsible for your own device protection.

5. Intellectual property

The Website and all content on it, including text, graphics, photographs, logos, trade marks, company names, designs, layout and software, are owned by or licensed to AFS Group and are protected by the Copyright Act 1987, the Trademarks Act 2019 and other intellectual property laws of Malaysia and other countries. You may view and print pages for your personal or internal business reference only, provided you keep all copyright and proprietary notices. You must not otherwise copy, reproduce, modify, distribute, publish, frame, sell or create derivative works from any content, or use any AFS Group name or logo, without our prior written consent. No licence or right is granted except as stated in these Terms.

6. Acceptable use

You must not:

• use the Website in any way that breaches any applicable law or regulation;
• attempt to gain unauthorised access to the Website, its servers or any connected system, or test its vulnerability without our written permission;
• introduce viruses, malware or other harmful material, or carry out denial-of-service or similar attacks;
• use automated tools to scrape, harvest or mine content or data, other than standard search-engine indexing that complies with our robots.txt;
• submit false, misleading, defamatory, offensive or unlawful material, or impersonate any person or organisation;
• send unsolicited advertising or spam through the enquiry form or our published email addresses.

We may suspend or restrict access to the Website and report any breach to the relevant authorities. A breach of this section may also be an offence under the Computer Crimes Act 1997 and the Communications and Multimedia Act 1998.

7. Enquiries and submissions

When you send us an enquiry, application or other material, you confirm that it is accurate and that you are entitled to share it. Unless we agree otherwise in writing, any submission is not confidential, and sending it does not create a contract, client, employment or fiduciary relationship. We are not obliged to respond to every enquiry. Unsolicited ideas or proposals may be used by us without obligation to you. Personal data in submissions is handled in accordance with our Privacy Policy.

8. Third-party links

The Website may contain links to third-party websites, including the separate websites of some group companies, for convenience only. We do not control and are not responsible for the content, availability, security or privacy practices of websites we do not operate, and a link is not an endorsement.

9. Disclaimer of warranties

To the fullest extent permitted by law, the Website and its content are provided “as is” and “as available”, and all warranties, conditions and representations, whether express, implied or statutory, including as to satisfactory quality, fitness for a particular purpose and non-infringement, are excluded.

10. Limitation of liability

To the fullest extent permitted by law, AFS Group and its directors, officers, employees and agents are not liable for any direct, indirect, incidental, special, consequential or punitive loss or damage, including loss of profit, revenue, business, goodwill, data or opportunity, arising from or in connection with your use of, inability to use, or reliance on the Website or any linked website, whether in contract, tort (including negligence), breach of statutory duty or otherwise, even if advised of the possibility of such loss. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud or for death or personal injury caused by negligence.

11. Indemnity

You agree to indemnify AFS Group against any claims, losses, liabilities, costs and expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Website.

12. Privacy and cookies

Our collection and use of personal data, and our use of optional analytics cookies, are described in our Privacy Policy, which forms part of these Terms.

13. Changes to these Terms

We may revise these Terms at any time by publishing an updated version on this page with a new effective date. Your continued use of the Website after that date means you accept the revised Terms.

14. General

If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in full force. Our failure or delay in enforcing any right is not a waiver of it. These Terms, together with the Privacy Policy, are the entire agreement between you and us concerning the Website. You may not transfer your rights under these Terms; we may transfer ours to another member of AFS Group or a successor. Neither party is liable for failure caused by events beyond its reasonable control. These Terms are written in English; any translation is for convenience, and the English version prevails.

15. Governing law and jurisdiction

These Terms and any dispute or claim arising from them or the Website are governed by the laws of Malaysia. You submit to the exclusive jurisdiction of the courts of Malaysia, although we may bring proceedings in any other court of competent jurisdiction.
